Let’s make it simple by having some general legal terms and conditions for service/s we offer. Terms and conditions mentioned below are for general understanding and not limited by mentioned in this document. We may change terms of services time to time and it will be applicable at any time if forced by circumstances and laws of any countries with or without prior notice.
Please read these terms and conditions carefully.
By using our service/s, you agreed to our terms and conditions by default. We encourage you to check deep knowledgebase for detailed explanation of any terms and conditions listed here or not, or contact us, if you have concern about any of our service/s prior to use.
These are the terms and conditions of service/s, we providing to you as a client. It is intended to ensure that you know your rights and obligations when using the service/s.
- General Agreement
Your agreement commences from the time you register for any service with us.
We will provide you with username and password to access account or control panel of related service/s. We will not change any user login data on your account unless requested by authorised account holder. Client is responsible to keep user credential secure.
Upon expiry or termination of this agreement, we may delete all of your data related to any service/s.
You will be charged according to service terms you agreed during your registration or purchase. Price may change in future and client will be notified where it’s possible and without absolute guarantee.
- General Maintenance
We must perform scheduled maintenance and other necessary updates to our servers with or without prior notice. We will attempt to perform all scheduled maintenance at times which will affect the least amount of customers. If scheduled maintenance requires the service to be offline for more than 30 minutes, we will notify clients on registered email address before 24 hours.
Under certain circumstances, we may need to perform unscheduled maintenance. If unscheduled maintenance leaves our service offline for more than 30 minutes, we will publish details of the event on our website “Announcement Board” where it is possible.
- Service Fees & Charges
You must pay for the service/s in advance. In particular, you must pay post charges where applicable. Eg. Excess usage of service/s.
We may suspend the service if client fails to comply with any part of the agreement including failure to pay charges till end of the agreement.
We must charge nominated account fees upon registration of service/s. Charges for service/s must be deducted from your preferred payment method and until agreed service terms as a one-time payment or recurring charges.
Auto-renew option available to avoid service disturbance and preferred payment method will be charged on or before expiry date of service/s.
If you decide to cancel any service at any time, you must provide us with a written confirmation to cancel your service before expiry date or cancel your service via self help portal (if applicable).
- Backup and Restore
As a website owner, your data is your property and it is your responsibility to protect your property. We recommend you to keep backups of your data for any situation where you can easily restore or move your data for optimal performance of your website.
Our system performs backup on a regular basis for the strict purposes of disaster recovery. In the event of equipment failure or data corruption, we will restore from the last known good archive. In the event of corruption of all our archives, or in the event that an old archive is used to restore the data, you should be prepared to upload your most recent data to server for your website.
Note: Backup of data at our end is free service and we providing with related services where possible without any commitment and guarantee of backup service.
- Services
Our role is to manage and maintain web hosting server hardware and software to keep it at optimal level of service and best performance. Our service does not include modifying client website files and related software unless separate service purchased from us.
Any services have limitations and so we do not warrant that the services provided under this agreement will be error free or uninterrupted or that the services will meet your requirements.
We strictly deny to host any kind of material, scripts or software that is illegal, contains adult material or prohibited by law of any country in the world. It is your responsibility to check content before you upload on server and failing to check your content may lead to cancellation of your service without any notice and no refund will be made for such activities.
We do not encourage to upload any kind of material that against any community around the world and may proceed with cancellation of your service without any notice and refund procedure. We also, notify legal authorities for such a behaviour and misuse of our service/s.
Our services won’t tolerate any kind of email spamming, fraud activities and other illegal terms which cause loss of any third-party properties. Failing to obey the law will lead to cancellation of services and prosecuted by law of any related country.
- Liabilities
We or our partners are not liable to you or any other person for any cost, loss or liability including loss of profit, loss of data, loss of emails, marketing expense or other consequential damage arising from our supply or failure or delay in supplying the Service.
You as a user responsible for all information and material published through our web hosting or related services. Client will not publish information which is illegal or inappropriate and restricted by the law in any country of the world.
Client is responsible for dealing with persons who access the data maintaining their website and related software.
Client will not violate copyright or other intellectual property rights. Client will not download, reverse engineer, change, pass on, or sell any material residing on our servers that is not the property of the client.
We reserves the right to immediately disable or remove client website/s that are the target of DDoS, hacking or any other sort of malicious attack that significantly degrades our server performance and other website/s hosted on server.
Clients with excessive or unreasonable requests to our technical support channels relating to issues outside of our role may lead to cancellation of service. In this case, compensation is limited to a pro rata based refund when no other discounts have been applied.
- Cancellation and Refunds
We do offer money back guarantee for various services and only applicable for valid period of newly registered client or service/s (does not apply to recurring services).
Refunds will not be granted for change of mind, or lack of website traffic. Refunds will not be granted if client realises are incompatible with scripts, languages and databases.
Full refunds will be made to client within agreed day/s while registration of service/s and cancellation made during valid terms of agreement.
We do not process refund for long terms agreements unless mentioned in related service documents.
- Governance
These terms and conditions constitute the entire agreement and supersedes all prior agreements. This agreement is created on basis of general web hosting services terms and applicable law by any part of the world. We do respect of any governance, law, community and legal authorities and encourage our client to check their entities before uploading to our servers or using our services.
Client is responsible for use of their account and do not permit or pass your credential to unknown person. If you permit others to use our services, you are responsible for making users aware about our terms and conditions.
It is your responsibility to use our services in a manner which does not violate any applicable laws or regulations.
- Rights
We reserve the rights to immediately action against any activities which is prohibited by any law around the world or not appropriate as per our terms. We may cancel your service in terms of violation of our policies, with or without prior notice.
We reserve the rights to change in any terms and conditions, fees or policies to comply with law and services, with or without prior notice.
